General Terms and Conditions

PART 1: GENERAL SECTION (APPLICABLE TO ALL USERS)

Article 1. Definitions

If the following names and terms are capitalized in these Terms and Conditions, these terms have the following meaning:

  • Deposit: A deposit required by the Service Provider from the User (default 50% of the sum, unless otherwise stated).
  • Additional Services: Services other than placing Advertisements online, such as intermediation of car rental, tour, and restaurant listings.
  • Service Provider: The provider of a holiday home, rental car, tour, religious service, restaurant or other activity.
  • Advertisement(s): The listing of a service or object on the Suriname Tourism Platform.
  • General Terms and Conditions: This complete set of terms and conditions of Suriname Tourism.
  • Payment request: Link sent by payment partner Stripe for secure payment processing.
  • Booking Request: The request of a Visitor for the rental or booking of an offered service.
  • Content: Images, videos and texts placed with Advertisements by Service Providers.
  • User(s): The collective name for Service Providers, Tenants, Travelers and Visitors.
  • Suriname Tourism Platform: The website and associated online environments.
  • Suriname Tourism: The platform manager responsible for mediating and publishing tourist services.

Article 2. Effective date, application and interim changes

These Terms and Conditions apply to all use of the Website and all services offered by Suriname Tourism, effective January 1, 2026.

  • Changes: Suriname Tourism reserves the right to amend these terms and conditions at any time.
  • Applicability: * For Visitors, the version available on the website at the time of their visit applies.
  • For Users (Renters), the version in effect at the time the Booking Request was submitted applies.
  • For Service Providers, the most recently amended version applies. Active Service Providers will be notified of significant changes via the administration environment or by email.

Article 3. Additional conditions (Stripe)

All payments on the platform are processed through our payment partner, Online Payment Platform (Stripe). By using Suriname Tourism, you also expressly agree to Stripe’s terms and conditions. These can be found on the official website of Online Payment Platform Stripe.

Article 4. Privacy Policy, Cookie Policy and Disclaimer

Suriname Tourism values ​​your privacy. In our Privacy and Cookie Policy (found at the bottom of the website), we explain how we handle your personal data and which cookies we use to ensure the website functions optimally.

Article 5. Functioning of the Website

Suriname Tourism strives for a flawlessly functioning website, but its accessibility depends in part on third parties (hosting and internet providers). The information in the Advertisements is compiled by the Service Providers themselves. We cannot guarantee that the website will always be accessible without interruptions or that all information provided by third parties is 100% accurate.

Artikel 6. Beperking aansprakelijkheid en vrijwaring

Suriname Tourism disclaims all liability, to the extent legally permitted, for any damage suffered by a User as a result of:

  • System outages, connection failures, or other technical defects.
  • Incorrect information in advertisements placed by Service Providers.
  • The use of the Website’s services.
  • Limitation: If Suriname Tourism is nevertheless deemed liable, compensation for damages will be limited to the amount of the (basic) rental fee or price of the service in question paid by the User.
  • Indemnification: Users indemnify Suriname Tourism against all third-party claims (including legal costs) arising from the agreement between the User and the Service Provider.

Article 7. Unauthorized use

Suriname Tourism owns the database and the website content. Without prior written permission, it is prohibited to:

  • Copy, reproduce, or store parts of the database or its content.
  • Collect personal data from other users.
  • Contact other users for commercial purposes outside of the platform. In the event of violation, we reserve the right to immediately deny access and take legal action.

Article 8. Explanation of Transfer and Force Majeure Application

  • Explanation: If a provision is unclear, the actual intent of the terms will be reviewed.
  • Transfer: Suriname Tourism may transfer its rights and obligations to third parties (for example, in the event of a takeover), while your privacy remains guaranteed in accordance with our policy.
  • Force Majeure: In situations of force majeure (war, severe weather, pandemics, strikes, or government measures), Suriname Tourism has the right to suspend or terminate the agreement without compensation.

Article 9. Transfer to third parties

Suriname Tourism may transfer its rights and obligations to third parties, provided that privacy safeguards are maintained.

Article 10. Force Majeure

In the event of force majeure (natural disasters, pandemics, government measures), Suriname Tourism may suspend its services without compensation.

Article 11. Abuse, Applicable Law and Disputes

  • Unlawful use: It is prohibited to use the website for immoral or criminal conduct. Advertisements will be removed immediately in the event of misuse.
  • Applicable law: All legal relationships in which Suriname Tourism is a party are governed exclusively by Dutch law.
  • Disputes: Disputes will initially be submitted to the competent court of The Hague. However, Suriname Tourism reserves the right to submit a dispute to the court that has jurisdiction according to law (for example, in Suriname, if applicable).

PART 2: CONDITIONS FOR USERS (TENANTS AND BUYERS)

Article 12. User and Service Provider Agreement

12.1 Formation and Parties: An agreement is concluded directly between you (the User) and the Service Provider once the Service Provider has accepted your Booking Request. Suriname Tourism is and explicitly does not become a party to the agreement you enter into with the Service Provider for the rental of accommodation, a vehicle, or the booking of a tour. You enter into this agreement independently. Suriname Tourism acts solely as a facilitator by providing the platform, sending the booking, and, through payment partner OPP, offering a secure payment environment.

12.2 User Responsibility: The User is fully responsible for all persons and animals (if explicitly permitted by the Service Provider) using the service during the period specified in the booking. Subletting accommodations or vehicles, or transferring tour tickets to third parties without permission, is strictly prohibited.

12.3 Duty to Investigate and Indemnification: Suriname Tourism is not liable for the state of maintenance, quality, or any defects of accommodations, vehicles, or the execution of tours. The User has a duty of care and should, if desired, request further information from the Service Provider regarding the quality, location, and reliability of the service offered. Suriname Tourism accepts no liability for damages resulting from the performance of the agreement by the Service Provider.

Article 13. Making payments, down payment and deposit

  • Deposit: A deposit of 50% of the total amount is required for final confirmation of a reservation, unless otherwise stated in the Service Provider’s specific terms and conditions. This deposit must be paid immediately upon acceptance via the platform.
  • Deposit: A deposit is required for accommodations and car rentals. The Service Provider determines the amount of this deposit and the deposit terms. The exact details are stated under the ‘Confirmation & Fee’ section or in the description of the property in question.
    Payment Terms: Balance: Unless otherwise stated in the booking confirmation, the following terms apply to the balance (the remaining 50%):
    Holiday Homes & Accommodations: No later than 30 days before the scheduled arrival date.
  • Car Rentals: No later than 14 days before the scheduled start date.
    Tours & Guide Services: No later than 14 days before the scheduled start date.
    Last-Minute Bookings (<30 days): The full amount (100%) must be paid immediately upon booking.
  • Restaurants & Discount Coupons: Immediately upon purchase or on-site as advertised.
    Consequences: In the event of late payment, the User will be in default and the reservation may be unilaterally canceled, with the deposit retained in accordance with Article 14.

Article 14. Cancellation Policy & Payment

If a User cancels a confirmed booking, the following cancellation fees will be charged based on the total booking amount:

  • More than 30 days before arrival: 25% of the total booking amount.
  • 15 to 30 days before arrival: 50% of the total booking amount.
  • 8 to 14 days before arrival: 75% of the total booking amount.
  • 0 to 7 days before arrival: 100% of the total booking amount.

    Suriname Tourism will pay out the funds resulting from the cancellation to the relevant Service Provider, after deducting the agreed brokerage fee (7.5% excluding VAT) and any transaction fees. This payment will be made within 14 business days after the cancellation is officially processed via the platform. Suriname Tourism is not liable for payment delays caused by external factors at the payment provider or banking institutions.

Article 15. Information and Advertisements

Suriname Tourism does not perform physical quality checks on cars or tours. Users are responsible for requesting any background information from the Service Provider.

Article 16. Booking process and conclusion of agreement

A Booking Request constitutes an official request from the User to the Service Provider to enter into an agreement for the selected service (accommodation, vehicle, or activity) for the selected period.

  • Acceptance: A definitive agreement is only concluded after the Service Provider explicitly accepts the Booking Request in the Suriname Tourism management environment.
  • Response Time: Service Providers are obligated to respond to a request as soon as possible, but no later than within five (5) days. If a request expires without acceptance, no agreement has been reached, and the parties are not entitled to any compensation.
  • Privacy: The User’s contact details will only be visible to the Service Provider after final acceptance.
    Own Terms and Conditions: The User is responsible for obtaining travel and cancellation insurance. The Service Provider applies its own specific terms and conditions for use and cancellation, as stated in the “Specific Booking Conditions” section.

Article 17. Complaints and Damages

If anything unexpectedly goes wrong before, during, or after the service, the User must discuss this immediately with the Service Provider to reach an amicable resolution within reason.

  • Complaints about the Platform: Complaints about Suriname Tourism’s services can be submitted via info@suriname-tourism.com. This must be done within two months of the situation arising. Suriname Tourism aims to respond substantively within eight weeks.
  • Damage and Deposit: The paid Security Deposit may be (partially) retained by the Service Provider to offset any proven damage found during the checkout/inspection. If the damage exceeds the deposit, the User and Service Provider must settle this between themselves.
  • Indemnification: Suriname Tourism is not responsible for the actual settlement of damages or the actions of the Service Provider regarding the deposit, but only facilitates the secure payment environment.

Article 18. Posting Reviews

Suriname Tourism values ​​transparency and traveler experiences.

  • Invitation: After the service ends, users automatically receive an invitation to post a review. This must be done within 30 days.
  • Publication: A written review is automatically published with the relevant Advertisement after 14 days. This period gives the Service Provider the opportunity to write an appropriate response.
  • Moderation: Suriname Tourism reserves the right to remove reviews or responses if they violate the guidelines (e.g., foul language or factual inaccuracies). Removed reviews are not included in the Service Provider’s average score.

PART 3: TERMS AND CONDITIONS FOR SERVICE PROVIDERS

Article 19. Advertising management

One advertisement per specific service. Suriname Tourism may modify advertisements for better presentation.

Article 20. Agreement, Commission and Payment

20.1 Establishment of Agreement: A definitive agreement between the Service Provider and the User will only be concluded after the Service Provider explicitly accepts a Booking Request in the Suriname Tourism management environment. The Service Provider will receive a notification of the Booking Request at the email address provided. The User’s contact details will only be visible to the Service Provider after the Booking Request has been accepted.

20.2 Commission: A commission of 7.5% (excluding VAT) will be charged on the total price of the service for each accepted Booking Request. Suriname Tourism does not charge any fees for providing the platform, unless the Service Provider uses additional services (such as promotional subscriptions) offered in the management environment. The commission will be automatically deducted from the amount to be received by the Service Provider upon payment to the Service Provider.

  • 20.3 Payment Schedule to Service Provider: Payment of funds (minus commission and any transaction fees) to the Service Provider will take place according to the following procedure:
  • Payment Time: Payment is initiated 24 hours after check-in (for accommodations) or 24 hours after the day of the activity/tour.
  • Payment Method: Payment is typically made via bank transfer to the Service Provider’s verified account number.
    Cash Payment: At the express request of the Service Provider, payment may be made in cash at Suriname Tourism offices.

20.4 Invoicing: After the commission becomes due, Suriname Tourism will provide a digital invoice within the Service Provider’s management environment.

Article 21. Promotion and Ranking Improvement

Suriname Tourism offers Service Providers the opportunity to increase the visibility of their Advertisements through specific promotional and ranking packages. These services are offered through subscriptions with a term of one (1) month, six (6) months, or one (1) year. The current rates for these subscriptions are listed on the Website. Subscriptions are billed according to the chosen term and must be paid in advance. Refunds are not possible for early termination of an ongoing subscription.

Article 22. Memberpages and Profile Presentation

22.1 Definition of Memberpage: Every Service Provider is allocated a dedicated “Memberpage” (Host Profile) on the Suriname Tourism Platform. This page serves as a centralized digital storefront where all active Advertisements, contact details (subject to the restrictions in Article 34), and background information of the Service Provider are displayed to Users.

22.2 Package Tiers and Limits: The functionality and capacity of the Memberpage depend on the chosen subscription tier (Basic, Premium, or Ultimate).

  • Basic: Includes a maximum of ten (10) active Advertisements.

  • Premium: Includes a maximum of twenty-five (25) active Advertisements.

  • Ultimate: Includes unlimited active Advertisements.

22.3 Exceeding Limits: If a Service Provider reaches the maximum number of Advertisements allowed under their current package, no new Advertisements can be published until:

  1. An existing Advertisement is deactivated or deleted; or

  2. The Service Provider upgrades to a higher subscription tier.

22.4 Upgrading and Commission: Service Providers may upgrade their package at any time via the management environment.

  • Upon successful processing of payment for a Premium or Ultimate subscription, the standard commission of 8% (as defined in Article 20.2) will be waived (0% commission) for all Booking Requests accepted after the upgrade activation date.

  • Commission already due or processed for bookings accepted prior to the upgrade remains non-refundable.

22.5 Content Optimization (Ultimate only): Service Providers with an active Ultimate subscription are entitled to professional support from Suriname Tourism regarding the optimization of texts and photos on their Memberpage to improve conversion rates.

22.6 Responsibility for Profile Accuracy: The Service Provider is solely responsible for ensuring that the information on their Memberpage, including company descriptions and operating hours, remains accurate and consistent with the individual Advertisements.

Article 23. Tax obligations

Service providers are themselves responsible for local Surinamese taxes and tourist taxes.

Article 24. Cancellation, rejection and misuse by Service Provider

24.1 Free Cancellation and Rejection If the Service Provider rejects or allows a Booking Request to expire, generally no commission is due to Suriname Tourism, unless there is abuse. Similarly, if an already accepted Booking Request is canceled before the scheduled start date, no commission is due, except in the cases of abuse mentioned below.

24.2 Definition of Abuse In these Terms and Conditions, abuse is defined as:

  • The systematic cancellation, rejection, or expiration of Booking Requests without valid reason.
  • Attempting to conclude an agreement outside of the Suriname Tourism Platform for the period requested in the Booking Request.
  • The cancellation of an accepted booking after the scheduled start date/arrival date. In this case, the Service Provider is liable for the full commission of 7.5% (excluding VAT) on the total amount.

24.3 Cancellation Obligations by the Service Provider If a Service Provider cancels an already accepted booking, the Service Provider is obligated to:

  1. Immediately refund the User the full amount already paid (including deposit and security); or
  2. Offer a suitable and equivalent alternative under comparable conditions.

24.4 Sanctions for Abuse To guarantee the quality of the Suriname Tourism Platform, Suriname Tourism reserves the right to impose the following sanctions if abuse is detected:

  • Ranking Penalty: Advertisements will appear lower in search results.
  • Take Offline: (Temporarily) disable advertisements.
  • Commission Fine: Charging a commission of 7.5% (excluding VAT), possibly increased by a fine of up to 100% of this amount in the event of circumvention of the platform.

Article 25. Freedom of the Service Provider

At Suriname Tourism, the Service Provider retains complete freedom to determine the specific terms and conditions under which it offers its services (accommodation, vehicle, tour, or activity). Suriname Tourism applies only a limited number of basic rules to guarantee the quality of the platform, as described in these Terms and Conditions.

As a Service Provider, you determine:

  • Which photos and texts you post (in compliance with the quality guidelines in Article 31);
  • What rates and seasonal prices you use;
  • The availability in the calendar of the relevant service;
  • The specific house rules and terms of use;
  • Whether, and if so, what amount of Security Deposit you use;
  • What specific payment terms apply for the remaining balance, provided these are clearly stated in the ‘Specific Booking Conditions’ section.

The Service Provider must at all times ensure that these terms and conditions comply with applicable local laws and regulations in Suriname and the overarching frameworks of the Suriname Tourism Platform.

Article 26. Payments via platform

26.1 Mandatory Settlement via Stripe All payments between the User and the Service Provider must be processed through the Suriname Tourism Platform’s payment partner (Stripe). The Service Provider will be notified by email of every received Deposit, Final Payment, or Security Deposit payment. Detailed information about the payment status is available at all times in the Service Provider’s administration environment and in the User’s account.

26.2 Payment Terms and Payment Link Processing The full booking amount, including any Deposit and local taxes, must be paid via the platform no later than the due date specified in the Booking Request. If full payment is not completed via the official payment links on the day of commencement (check-in or activity start), these links will expire.

  • In that case, the Service Provider is responsible for collecting the outstanding amounts via an alternative method.
  • Suriname Tourism is expressly not liable for non-payment or late payment by the User.

26.3 Commission Settlement The commission invoice for Suriname Tourism (7.5% excluding VAT) is automatically generated on the booking start date. As stipulated in Article 21, this commission is immediately deducted from the payment that is transferred to the Service Provider 24 hours after the booking start date.

26.4 Last-Minute Bookings Notwithstanding the standard 50% deposit policy, the Service Provider cannot offer split payments if the booking start date is within 14 days of the acceptance date. In such “last-minute” cases, the User must pay the full amount (100%) immediately upon booking to secure the booking.

26.5 Specific Booking Conditions The Service Provider is obligated to clearly state the exact payment terms for the remaining balance and the deposit amount in the “Specific Booking Conditions” section of the Advertisement. In the event of any conflict between the Service Provider’s text and these Terms and Conditions, the Terms and Conditions of Suriname Tourism shall prevail.

Article 27. Payment term for Additional Services

Payments by the Service Provider for additional services (such as promotional subscriptions) must be made within fourteen (14) days of the invoice date via the online payment methods offered by Suriname Tourism. These invoices cannot be paid by manual bank transfer; payment must be made via the payment links in the administration environment. Suriname Tourism does not charge any fees for basic use of the platform, except for commission on bookings and the costs for optional additional services.

Article 28. Statutory Interest and Collection Costs

After the payment term expires, the Service Provider is legally in default. From that moment on, the Service Provider owes statutory (commercial) interest on the outstanding amount. If payment is not received, the claim will be transferred to a debt collection agency after 60 days. All additional collection costs will be borne entirely by the Service Provider. In the event of bankruptcy or suspension of payments, all claims of Suriname Tourism are immediately due and payable.

Article 29. Suspension

As long as a Service Provider fails to pay an invoice due or otherwise violates these terms and conditions, Suriname Tourism is entitled to suspend its services. This means that Advertisements will be (temporarily) taken offline and access to the management environment may be denied. The Service Provider’s payment obligations remain in full force during the suspension period.

Article 30. Termination of Agreement and Termination

The agreement between Suriname Tourism and the Service Provider is entered into for an indefinite period and can be terminated by the Service Provider at any time. Suriname Tourism may terminate the agreement immediately if the Service Provider:

  • Structurally misuses the platform;
  • Posts content that infringes the rights of third parties;
  • Is the subject of repeated, substantiated complaints from Users.

Article 31. Advertisement and Content

All Content (text, photos, video) must accurately and accurately reflect the service offered. It is prohibited to post Content with watermarks or logos from other platforms. The Service Provider guarantees that it has the necessary licenses for the material used and indemnifies Suriname Tourism against any claims from third parties. Upon posting, the Service Provider grants Suriname Tourism an irrevocable license to use the Content for marketing purposes on the platform.

Article 32. Provision of data

The Service Provider guarantees that all information provided (such as permits, bank details, and descriptions) is correct and complete. The Service Provider must ensure a working email address is checked weekly to ensure timely processing of booking requests.

Article 33. Account access and security

Suriname Tourism has access to the Service Provider’s account for management and configuration purposes. The Service Provider is responsible for maintaining the confidentiality of login credentials. Suriname Tourism is not liable for damage caused by unauthorized access (hacking) or loss of data by third parties.

Article 34. Service messages

Service providers receive service messages via email or through the management environment with tips for optimizing their advertisements. These messages are an integral part of the service provided.

Article 35. Rules for Advertising Rules for Advertising and Circumvention

Suriname Tourism is intended for local providers who present their services with care. It is strictly prohibited to include contact information (phone number, URL, social media) in advertisements or messages with the intention of redirecting bookings outside the platform. If such circumvention is detected, a penalty of €50 (excluding VAT) per incident may be imposed, in addition to the commission due.

Article 36. Compliance with local laws and regulations

Service providers guarantee that they comply with all local Surinamese laws (such as tourist taxes, business licenses, and transport permits) before offering their services. Suriname Tourism reserves the right to block accounts if illegal activity is suspected.

Article 37. Languages

Service Providers must be fluent in at least one supported language (Dutch or English). Listings may be automatically translated by the platform; however, the Service Provider is responsible for verifying the accuracy of these translations in the “Specific Booking Conditions” section.

Article 38. Calendar Management and Responsiveness

The Service Provider is obligated to keep the availability calendar up-to-date daily. Allowing requests to expire or rejecting them without justification will harm the Advertisement’s ranking. In the event of persistent inactivity, Suriname Tourism may temporarily take the Advertisement offline to prevent disappointment among travelers.

Article 39. Review and Moderation

After booking, users can leave a review. The Service Provider has 14 days to respond to a negative review. In the case of unjustified reviews, the Service Provider can submit a report to Suriname Tourism, which will then be subject to an independent assessment in accordance with the moderation guidelines.

Article 40. Equal treatment Equal treatment and non-discrimination

Suriname Tourism has a zero-tolerance policy regarding discrimination. Service providers may not refuse bookings based on origin, religion, gender, sexual orientation, or disability. Violation of this policy will result in immediate termination of the agreement.
